Alleged Thieves Steal The Surveillance Cameras; Felony Arrest – GARLAND COUNTY

All suspects are presumed innocent until determined guilty in court.

Garland County Sheriff’s Office Investigator Yoak reports the following:

On 09/26/19 dispatch received a call in reference to a residential burglary in progress  in the 900 block of Promise Land Rd in Hot Springs, AR.

I, Inv. Yoak arrived on scene and saw two male subjects, one later identified as Rickey Powell, and one female subject later identified as Marsha Avery attempting to change a tire on their vehicle, in front of the residence that the call was referring to.  The vehicle showed registered to Marsha Avery.  I asked them to step away from the vehicle.  Deputy McConnell, Deputy Morgan, and Deputy Stringer arrived on scene.

Parolee Rickey Dale Powell, 43, of Duckhole Trail in Lonsdale – allegedly admitted to stealing cameras off a home and items from a shed, with meth in his pockets.

Marsha Jean Avery, 54, of Gibson Street in Hot Springs – allegedly found with stolen items in her vehicle while on parole/probation.

Dep. Morgan and Dep. McConnell went down to the house to investigate the residence.  While checking the residence they found that several cameras had been torn off the house.  During the check of the house they noticed the storage shed door had been pried open.

Dep. Stringer called the homeowner to verify the location of the cameras.  Rickey Powell then approached me and stated that he had taken the cameras off of the house.  He then reached in his front pants pocket and handed me two video cameras.

I then placed him into custody for Criminal Mischief 2nd Degree.  During the pat down he then stated that he had some dope in his pocket.  I found a syringe and a small bag of approximately 1.0 gms of a crystalline substance that later tested positive for presumption of methamphetamine in his front left pocket.  I then placed him in Dep. Morgan’s vehicle.

Upon an ACIC check of Marsha Avery it was found that she had a search waiver on file.  During a search of the vehicle a Stihl weed eater, gas can and an axe was located in the vehicle.  The owner verified that all those items were his and had been in the storage shed.  Powell made a statement that he had broken into the shed and taken the items from the shed.  These items were photographed and released to the owner.

Based on these facts Rickey Powell is charged with Possession Of A Controlled Substance (D Felony), Possession Of Drug Paraphernalia (D Felony), Breaking And Entering (D Felony) and Criminal Mischief (A Mis).  Mr. Powell has bond amount totaling $7,500 for his charges, and a parole hold has been placed.

Based on these facts Marsha Avery is charged with Theft By Receiving, with a $1,000 bond.
